How to protect your brand with Australian trade mark registration process
Tell me about registering a trade mark
Using a trade mark may establish some common-law rights, but registering it offers significant benefits. Registration provides legal proof of ownership and exclusive rights to use the trade mark with your goods or services. It also helps prevent others from using a similar trade mark that could mislead or confuse consumers. A registered trade mark allows you to take legal action against those who infringe on your rights. Company and business names do not grant those rights, only a trade mark does. Additionally, it is illegal to use the ® symbol unless the trade mark is officially registered. Registering your trade mark is a vital step in safeguarding your business or product brand.
In the Plan phase, you pick a name and decide on the scope of a Search for similar, existing names to see if it’s available for registration as a trade mark, then decide how much help you may need to Apply for your trade mark.

Searching Trade Marks Data
A trade mark can be words, logos, images, sounds, scents, or a combination of these. It grants exclusive rights to use the trade mark for the goods/services it’s registered for. It must be distinctive and not descriptive to qualify for registration.
The Trade Marks Office offers three search tiers to protect your intellectual property, each designed for different business needs and budgets
Begin with our Free search of IP Australia’s trade marks registry – a no-cost way to check existing registered marks and pending applications in the Australian database
Take your search further by including (in addition to the results of the Free Search) ASIC business and company names, trade directories, selected top-level domain name registries (TLDs), and Australian domain names (.com.au and .au), revealing unregistered trade mark usage that could affect your rights
All paid searches include expert analysis of results by a registered trade marks attorney / practising intellectual property lawyer, helping you understand potential risks and opportunities for your trade mark application, maximising your chances of successful registration
.
